A fair, transparent, and consistent approach to programme fees, cancellations, withdrawals, and refunds.

1 Purpose

MyMaximus College UK Ltd is committed to maintaining a fair, transparent, and consistent approach to programme fees, cancellations, withdrawals, and refunds.

This policy explains when a learner may cancel an enrolment, request a refund, or become liable for programme fees.

This policy should be read together with the learner's enrolment terms, programme information, and any applicable payment agreement.

2 14-Day Cancellation Period

Where applicable under UK consumer law, learners who enrol and enter into a contract online, by telephone, or through another distance-selling method may have the right to cancel within 14 days without giving a reason.

The cancellation period normally begins from the date the relevant contract is concluded.

A learner wishing to exercise an applicable cancellation right should notify MyMaximus College UK Ltd clearly in writing within the relevant cancellation period.

Where a valid cancellation is received within the applicable 14-day period and training has not commenced at the learner's express request, payments received will normally be refunded in accordance with applicable UK consumer law.

3 Starting a Programme During the Cancellation Period

A learner may request that educational, or training services begin during an applicable 14-day cancellation period.

Where a learner requests an early start and subsequently cancels during that period, MyMaximus College UK Ltd may, where legally permitted, charge an appropriate amount for services already supplied up to the date cancellation is communicated.

Where a service has been fully performed during the cancellation period following the learner's express request and acknowledgement, statutory cancellation rights may be affected where permitted by law.

4 Cancellation Before a Programme Begins

Where a learner cancels after any applicable statutory cancellation period but before the programme starts, eligibility for a refund will depend on:

  • The enrolment terms are accepted by the learner.
  • Costs are already reasonably incurred.
  • Registration or administration already completed.
  • Awarding-organisation or examination registrations already made; and
  • Any other non-recoverable third-party costs incurred on the learner's behalf.

Any deductions will be communicated where applicable.

5 Withdrawal After the Programme Has Started

Where a learner voluntarily withdraws after their programme has commenced, fees will not automatically be refundable.

Any refund or outstanding fee calculation will take into account the learner's contractual and statutory rights and may consider:

  • The proportion of the programme has already been delivered.
  • Access already provided to digital learning materials or platforms.
  • Teaching, tutoring, assessment, or support already provided.
  • Registration with an awarding organisation.
  • Examination or assessment fees already incurred; and
  • Other reasonable and non-recoverable costs associated with the learner's enrolment.

Learners should contact the College as soon as possible if circumstances require them to withdraw.

6 Registration, Assessment & Third-Party Fees

Certain fees may be paid by MyMaximus College UK Ltd to award organisations, examination bodies, assessment organisations, certification providers, or other third parties.

Once such registration, examination, assessment, certification, or similar costs have been incurred and cannot be recovered, they may be deducted from an otherwise applicable refund, where permitted by law and the learner's contractual terms.

7 Digital Learning Materials

Where learners receive immediate access to digital content, online learning resources, or other digital services, cancellation and refund rights may be affected depending on the nature of the content, whether access has begun, and any consent or acknowledgement provided by the learner.

MyMaximus College UK Ltd will apply the relevant requirements of UK consumer law when determining eligibility.

8 Programme Cancellation by MyMaximus College UK Ltd

If MyMaximus College UK Ltd cancels a programme before it begins and cannot provide a reasonable alternative, learners will normally be offered:

  • Transfer to an appropriate alternative programme or intake; or
  • A refund of eligible programme fees paid directly to MyMaximus College UK Ltd.

Where a programme has already commenced and circumstances require significant changes or cancellation, we will communicate available options to affected learners and act in accordance with applicable contractual and consumer-law obligations.

9 Programme Changes

We may occasionally need to make reasonable changes to programme schedules, tutors, delivery methods, learning platforms, or other operational arrangements.

Minor or reasonable changes do not automatically create entitlement to a refund.

Where a material change significantly affects the service contracted for, the learner's applicable contractual and statutory rights will be respected.

10 Exceptional Circumstances

Where a learner needs to withdraw because of serious and exceptional circumstances, MyMaximus College UK Ltd may consider the circumstances individually.

Supporting evidence may be requested where appropriate.

Depending on the circumstances, available options may include a programme deferral, transfer, credit, payment adjustment, or refund where appropriate.

Any discretionary consideration under this section does not affect a learner's statutory rights.

11 How to Request a cancellation or Refund

Requests should be submitted in writing to MyMaximus College UK Ltd and should include:

  • Learner's full name.
  • Programme or qualification.
  • Enrolment or learner reference, where applicable.
  • Date of enrolment.
  • Reason for the request.
  • Date the cancellation or withdrawal is requested; and
  • Relevant supporting information where required.

We will acknowledge and assess requests and communicate the outcome to the learner.

Where a refund is approved, it will normally be returned using the original payment method where possible.

12 Refund Processing

Approved refunds will be processed within a reasonable period and in accordance with applicable legal requirements.

The time required for funds to appear in a learner's account may also depend on the bank, card provider, or payment processor.

13 Instalment Plans

Withdrawal from a programme does not automatically cancel outstanding payment obligations.

Where a learner has an instalment arrangement, any amount payable following cancellation or withdrawal will be determined according to this policy, the applicable enrolment agreement, services already supplied, and the learner's statutory rights.

14 Chargebacks & Payment Disputes

Learners are encouraged to contact MyMaximus College UK Ltd first if they believe a payment has been made incorrectly or a refund is due.

This allows us to investigate the matter and seek an appropriate resolution.

Nothing in this policy prevents a learner from exercising any legal rights available through their payment provider or applicable UK law.

15 Complaints

If a learner is dissatisfied with the handling of a refund or cancellation request, they may raise the matter through the College's complaints procedure.

Refund decisions will be reviewed fairly and with consideration of the learner's contractual and statutory rights.

16 Statutory Rights

Nothing in this Refund & Cancellation Policy is intended to exclude, restrict, or override any rights or remedies that a consumer may have under applicable UK law.

Where there is any conflict between this policy and a mandatory statutory consumer right, the applicable statutory requirement will take precedence.

17 Policy Review

MyMaximus College UK Ltd will review this policy periodically to ensure that it remains appropriate for our programmes, enrolment arrangements, and applicable legal requirements.
